A 44-year-old man was seriously injured on Sunday evening in Schaerbeek. The incident happened around 22:30 and according to the first investigation data, a 44-year-old Albanian was shot with several bullets in the head and chest, while his life is in danger.
The public prosecution of Brussels did not communicate anything about the motive of this fight. But a journalist specializing in criminal matters in Albania contacted our editorial office to get more information. For him, it is clear that this is a settlement of scores between the two families. "In Albania, his brother was convicted for the murder of two people", he told us.
Our source is clear: the victim of the attack in Schaerbeek on Sunday is Agustin Kaza, 44 years old, originally from Albania. We do not know how long he has been in Belgium, nor whether he has stayed illegally, but he had been denounced in the past for membership of a criminal organization and had not been "alive" to the Belgian authorities for more than 5 years.
On Sunday, he was allegedly shot in revenge for his brother's actions 26 years ago. "According to the information we have access to here in Albania, Agustin Kaza is related to Martin Kaza, they are brothers", the journalist specialized in criminal events tells us. "We have this information from our sources within the Albanian police, but the authorities have not yet made an official statement", continues our interlocutor.
Martin Kaza was convicted of murdering two brothers, Dod and Augustin Gjini, on July 3, 1997 in Mirdita, a town in northern Albania. At that time it was said that the murder was carried out for revenge, since in 1994, in the town of Rreshen, Ndue Kaza, the brother of Martin and Agustin Kaza, was killed.
Ndue Kaza is suspected to have been killed on January 7, 1994 by Dod Gjini. To avenge his brother, Martin Kaza killed Dod and Augustin Gjini before fleeing. According to some Albanian media, Martin Kaza then fled to England to seek asylum, claiming to be a war refugee from Kosovo. There, he allegedly used a false identity, calling himself Naim Karagjia.
Only in June 2016 he was arrested in London. He was then extradited from Britain to Albania in December 2017, where he was sentenced to 22 years in prison for his double murder.
The Law of the "Canon"
Albanian media say that the events that took place in Schaerbeek on Sunday evening were carried out by a hitman, as part of a revenge. This information, however, has not been confirmed by the public prosecution of Brussels, which continues to investigate. "Albanian and Belgian police are in communication about this case and his past", says the Albanian journalist.
But for our interlocutor, Augustini was a victim of what is called "Canon" in Albania. "Many murders are committed here for reasons of revenge, because in the north there are still people who follow the law of the Kanun: the Lekë Dukagjini Kanun," he explains.
According to a political scientist specializing in Albania and organized crime, the Canon was "a text of customary law in Albanian society in the Middle Ages".
In this text there is a notion of "transversal" revenge. "If the person who hurt us is not found and we cannot take our revenge directly on him, there is the possibility of attacking another person in his family, but who must be of the same blood on the father's side," explains the specialist. .
Please note that the Canon cannot be applied inside the person's home. This means that if the person is locked in the house, he cannot be killed. In Albania, the law of the Kanun is still often used. "About a year ago, a group from London was paid to come here and kill a businessman in Albania, almost 20 years later, simply because of the laws of the Kanun," he says.
"In Albania we have the laws, the Constitution and the Penal Code. The laws of the Kanun are very old, but in the north of Albania you can find some families - even if they are few - that still use these laws.
