SPAK has appealed the decision on the 15-year prison sentence of the associate of Justice, Ervis Bardhi, who showed the implication of Çapjave and three other people in the criminal event where he was killed, Gentian and Nezir Beqiri in Elbasan.
In April 2023, GUKKO judges Etleva Deda, Irena Gjoka and Erjon Bani sentenced the associate of justice Ervis Bardhi to 15 years in prison.
While the Special Prosecutor's Office had requested for him a sentence of only é việt imprisonment. This lenient criminal policy for the case of the defendant Ervis Bardhi was followed because he signed a cooperation agreement with the prosecution, where in exchange for a lenient sentence he agreed to speak, showing the entire dynamics of the event, the authors of crime and the two financiers, Ardian and Florenc Çapja.
According to the Prosecutor's Appeal, the sentence of 15 years imprisonment given by the GJKKO, does not justify the fact of doing justice, by toughening the criminal policy in the pergon who showed fullnet and confidence to cooperate with the investigative bodies.
Based on this situation, the prosecution requests in the Appeal, the annulment of the decision for the tax portion of Ervis Bardhi, declaring the latter guilty of three serious criminal offenses and his sentence of 6 years of imprisonment.
Meanwhile, the other defendants, such as Ardian Çapja and Florenc Çapja, who were sentenced to life imprisonment, appealed to the Court of Appeal. The uncle and nephew are seeking the annulment of the verdict and their declaration of innocence.
