The Albanian woman refuses to return to her homeland: I fell in love in prison

An Albanian woman who was a member of a gang that robbed 26 houses in a month and a half in 2019 appealed against being deported from the country. One of the three members of the gang of Albanian robbers arrested in 2019 in the so-called 'Operation Santa Isabel', to whom 26 robberies have been attributed in a month and a half, wants to stay in Spain after finding love in A Lama.

The woman, who has already served her sentence, appealed the order requiring her to be forcibly removed from the country, alleging a violation of her rights, including the rights of her partner, a Spanish national whom she met in prison. , who owns a car repair shop and is looking to start a family with him. According to her defense in the said appeal, the woman regularly entered the country via a flight from Rome and during the three-month period as a tourist she was detained and then tried. After serving her sentence she was transferred directly from prison to the airport and her partner went to Albania where they got married, as they could not do so in Spanish territory as the woman's documents had been withheld by the Spanish authorities.

The High Court of Justice with a decision last November, where it rejected the claims of this citizen. She recalls in her decision that she was arrested immediately after arriving in Spain as a suspected perpetrator of crimes as a member of a criminal group, forgery of documents, robbery by force, theft of license plates, possession of weapons without a permit, waiting and money laundering, for the events that took place in November 2019, where in the company of two other members of the group, she rented a holiday home, presenting a fake Greek identity card in the name of another person.

After being remanded in custody at A Lama, she met her romantic partner there with whom she later lived when she was released before returning to prison to serve the sentence imposed by the Court. So, it is said that there are numerous aggravating circumstances that determine the admissibility of the agreed exemption without any violation of rights, "since the arrests and criminal files are accredited in the court records". Furthermore, regarding the relationship with a Spanish citizen, the court states that "the evidence taken in this regard was only the statement of the man who claimed to be her partner and who showed his willingness to live together, without any record of registration in the Register of "de facto couples". Also, it is emphasized that "there is no documentary evidence" that proves the marriage in Albania and that the relationship of the couple and their marriage can be claimed in the corresponding administrative request.

In this way, the Galician Supreme Court rejects the appellant's request, with costs imposed, although an appeal to the Supreme Court is possible.
