The Special Court of First Instance decided on Tuesday, November 21, to separate the trial of the case in charge of Bulqiza Municipality officials, including the former socialist mayor, Lefter Alla, who are accused of corrupt affairs in a tender worth nearly 2.8 million euro, which aimed to renew the sewerage network in the oldest quarter of the city.

The legal representative of the defendant Lefter Alla, who was not present in the courtroom, requested that the case for her client be separated from two other defendants who have requested a regular trial, as he himself has requested a shortened trial. The legal representatives of ten other defendants, Enkeleda Lleshi, Rubin Kola, Arsen Gjoka, Kujtim Zogu, Denis Xholi, Lonard Daçi, Erjon Isaku, Rasim Daci, Aqif Konesha and Dali Gazidedja, also requested the same.

While the lawyers of the defendants, Ana Nishku and Kastriot Ibrahimaj, remained in the search for an ordinary trial. The presiding judge, judge Atalanta Zeqiraj, announced the interim decision on the acceptance of the request for the separation of the trial and invited the parties to present the final conclusions. The prosecutor of the case, Dorina Bejko, asked for time, and the court adjourned the hearing to December 4, at 3:00 p.m.

The prosecution finds that the procurement procedure was initiated and developed in violation of the law "On public procurement" and by-laws, since on the part of Alla, the deputy mayor of the Bulqiza Municipality Enkeleda Lleshi, as well as the members of the Procurement Unit and the Evaluation Commission of the Offers, contrary active actions have been taken, consisting in the establishment of a special mechanism, for the predetermination of the winner, although this subject did not fulfill all the criteria. According to SPAK, although Rafim Daci was declared the winner, the works were carried out by Aqif Konesha who was not declared the winner, as he did not meet the legal criteria and that this was done in order not to create doubts about the latter's connections with the mayor of Bulqiza , the defendant Lefter Alla. The investigation has shown that the defendant Aqif Konesha has close ties with the mayor Lefter Alla.

Also, the prosecution says that it has been proven that the entity announced as winner made payments in favor of the member of the Public Procurement Commission, the investigated Erion Isaku.

While the administrators of the two companies involved, Rasim Daci and Aqif Konesha, as well as the supervisor of the works, Ana Nishku and the technical manager of the works, Dali Gazidedja, are accused of having compiled forged documents during the implementation of the contract, reflecting the false fact that the works were completed. from the winning firm of the procurement procedure. Kastriot Ibrahimaj, who, like Nishku, requested an ordinary trial, is accused of the criminal offense of "Forgery of seals, stamps or forms". / BIRN
