The Court of Appeal in Tirana has decided that Sali Berisha will receive the seal of the Democratic Party.
The court did not accept the appeal of Lulzim Basha, leaving in force the decision of the Court of First Instance that the seal belongs to Sali Berisha.
For more than 2 hours of court session, the legal representatives of the official Democratic Party of Lulzim Basha and the democratic group of Reestablishment of Sali Berisha were heard.
The judging panel was composed of the relator Alma Ahmeti and members Iliba Bezati and Elona Toro.
From the official PD, Indrit Sefa, Rezart Kthupi and Endri Hasa appeared in court, while from Rithemelimi, along with the legal representatives, there are also the main supporting deputies such as Flamur Noka, Gazment Bardhi, Agron Gjekmarkaj.
Both sides affirmed yesterday that they will not have additional requests, which would lead to the postponement of the hearing and, consequently, the decision on the DP seal.
For two and a half years, the battle for the seal of the Democratic Party has been going on between the democrats of Lulzim Basha and Sali Berisha with the hope of a final decision that will resolve once and for all the legal fate of the largest opposition party.
The battle between the two groups of Democrats during these two and a half years of rift has not only been legal. January 8, 2022 culminated in a physical clash between the Reestablishment of the official DP, where only the intervention of the police avoided fatal consequences.
In the session of December 27 of last year, the Supreme Court asked the Appeal to make a final decision on this issue. In its arguments, the Supreme Court stated that Appel had not conducted a thorough investigation of the case, had not understood the nature of the dispute and had misinterpreted procedural norms and law.
