Former prosecutor Ervin Karanxha has commented on the investigations against Tirana Mayor Erion Veliaj, which led to his arrest on the orders of SPAK.
Karanxha emphasized that Veliaj's lawyers should have presented all their claims and requested from SPAK head Altin Dumani the dismissal of the prosecutor in the case, Olsi Dado.
"There were claims from Veliaj in the session, the court ordered the arrest measure, while the lawyers should have presented their claims with a written memo. In this case, the Criminal Procedure Code stipulates that any concerns must be raised in a timely manner. If there were grounds for the prosecutor's exclusion, his exclusion should have been requested. The battle takes place in court, where the claims are defended," the former prosecutor told "Euronews Albania".
He also expressed reservations about SPAK's standards in the Veliaj case, arguing that the mayor should not have been held under the "prison arrest" security measure.
"We are dealing with other cases where SPAK has imprisoned other people under the same conditions, but I personally do not agree. Veliaj could be investigated at liberty, as he is a public figure and does not pose a flight risk. In the United States, for example, the standard is different. The Mayor of New York has been investigated under the 'compulsion to appear' measure for corruption issues, and even the former American president has had 98 charges without being arrested ," Karanxha said.
According to him, this standard created by SPAK is dangerous and could have far-reaching consequences.
"The internationals who supported this process have already left, while the established standard remains and in my opinion is dangerous," he concluded.
