The new budget law includes a “fiscal peace” that forgives tax obligations for 202 thousand citizens, but the real goal is to erase the huge debts of about 200 powerful companies. The amount forgiven is not made public. The list includes taxes, customs, interest on arrears, energy debts, water and environmental fees. Meanwhile, businessmen like Luan Bregasi, investigated for forgery and non-payment of insurance, benefit millions, while ordinary citizens are fined for minimal delays. Fiscal peace in Albania has no transparency and does not require any obligations from beneficiaries, turning into a pure amnesty scheme for political clients.
The majority approved the budget presented by the government in Parliament without any obstacles, while the opposition did not react to raise the alarms that this law brings. The most silent part is the so-called "fiscal peace", which is not peace, but a massive amnesty that forgives the tax obligations of 202 thousand citizens who possess a NIPT in the tax directorate.
Hundreds of thousands of citizens serve as cover for more than 200 large businesses. The obligations of legal entities or small businesses do not have to be included in such a “peace”. This is because, with a law adopted in 2021, small businesses and legal entities are exempt from taxes until 2028. Therefore, their inclusion in the amnesty is unjustified and worthless.
All this is done to hide the main goal. The “fiscal peace” serves to erase the huge liabilities of large companies for 10 years. Liabilities that include staggering amounts, which the draft does not make public. They include unpaid tax liabilities, relevant commissions, customs duties, interest on arrears, unpaid bills for energy, water, gas, as well as fees for the environment, property, urban waste and others.
An ordinary citizen, in case of delay in obligations due to vital reasons, such as illness or economic impossibility, is fined or may be arrested. Meanwhile, a large business connected to the government can commit endless violations and in the end be forgiven without consequences.
In reality, fiscal peace is a serious constitutional violation. If the opposition or a group of citizens appeals, the law can be overturned. The Constitution of the Republic clearly states that everyone is equal before the law. Failure to pay fiscal obligations is considered a criminal offense. This beneficial caste is in a conflict of interest, because it is strongly linked to politics.
Luan Bregasi, deputy mayor of Tirana City Council, is one of the biggest beneficiaries of this fiscal peace. Bregasi, owner and manager of Birra Tirana, is under investigation by taxes, customs, the prosecution, economic crime and the courts. He has violated tax obligations, falsified balance sheets and hidden income. Non-payment of social and health insurance creates a burden for employees and burdens the state with obligations that all citizens pay.
The money that the government forgives to so-called businessmen is public money. The government has no right to forgive or amnesty them except by a court decision on a case-by-case basis, not by en bloc decisions. The state must hold all lawbreakers accountable, seizing their assets, and most of these assets are national property.
The clearest case is the Birra Tirana factory, which Ilir Meta gave to a group of commissioners who degraded it and want to sell the land for construction. The factory's documents clearly show the falsification of income and balance sheets.
A normal fiscal peace is not unknown in the world. But it is done after transparent processes, where citizens are informed in detail, and the beneficiary groups are forced to contribute to other social strata. In Europe, large businesses are forced to pay 70 percent of the salaries of employees they lay off. In the US, New York and California force conglomerates to build social housing. In Italy, every year "condonos" are made for unauthorized construction, requiring adaptation to the urban plan and employment.
