The appointment of the new head of the National Bureau of Investigation (BKH) has been accompanied by public discussions about the selection process and possible political or institutional influences. Rumors have circulated that the winning candidate was the favorite of the head of the Special Prosecution Office (SPAK), Altin Dumani, suggesting that there was lobbying in his favor.

For lawyer Redi Ramaj, the choice of the head of the BKH is not about individual preferences, but about criteria set by law.

In an interview for the show "Të Pashoj" on Pamflet's YouTube channel, Ramaja said that the Director of the BKH does not need to be a person supported by the heads of the prosecution, as the institutional structure itself provides for autonomous activity in terms of investigation.

Excerpt from the interview:

– It has been said throughout this time, at least in the two months that Joni Keta has been in charge of the BKH, that he was the preferred candidate of the head of SPAK, Altin Dumani, and all the lobbying has been in service of his candidacy. Does this cast doubt on the process?

Ramaj : Look, I think we shouldn't focus on discussions about who was the favorite of one person, the chairman of SPAK or the commission, or the other members of the commission. Why do I say this?

Other names have also been discussed during this process, which could be figures proposed or supported by a faction of the Special Prosecution. Which did not result for most of the names and I think it does not have to result for Mr. Keta. The fact that, as I said, the filtering and the process was long and well thought out, ultimately arriving at a figure, shows that the aspect of the criteria and definitions required by the law was respected.

I do not believe that the head of the BKH must necessarily be a person supported or who has interests related to members of the Special Prosecution Office. Why do I say this? Because the BKH in its organization is a structure that, regardless of who is the head, the role in the investigations is played by the officers themselves, who work under the authority of various prosecutors. So, even though it is a parallel body to the Special Prosecution Office, most or almost all judicial police officers, part of the BKH agency, are coordinated or connected with one or several prosecutors in their investigations.

Most important in this whole process is the fact of how the body functions in general. The influence of the leader will have an acceptable, but not decisive role in the way the BKH functions. Coordination will always be done with the Special Prosecutor's Office for the investigations carried out, and the main decisions will be made based on the needs of the prosecutor's investigation. This is at least how I read the law.

That's why I say that the name matters, but at the same time it doesn't matter, because at the end of the day, individuals, BKH agents, individually make the difference in the investigation of cases and in the justice that every citizen receives, always under the supervision and direction of the prosecutor.
