The Prosecutor's Office of Tirana has closed the investigations for the Rraja tribe who barbarically raped two cousins, Bilbil and Jashar Maja, while the accusation given is ridiculous.
Prosecutor Ylli Bashaj has closed the investigations in charge of the defendants; Eni Kullaj, Andi Rraja, Ineidi Raja, Përparim Rraja, Xelal Rraja, Flamur Rraja, Rexhep Rraja, Klajdi Rraja and Edison Meta.
The Rraja gang is accused of the criminal offenses of 'Intentional light injury' and 'Intimidation'.
We recall that members of the Rraja tribe barbarically raped and threatened with weapons a few months ago the two cousins Bilbil and Jashar Maja in a bar in Thumana. The two cousins had complained that the quarries owned by the brothers of former MP Rrahman Rraja were damaging their homes from uncontrolled explosions. The latter resigned after this event, where Rrahman's son, Rexhepi, as well as brothers Flamur and Xelal Rraja, their cousin Përparim Rraja, Klajdi Rraja and Edison Meta, who have been declared wanted by the police, were also seen in the video made public.
Ineidi Rraja, Eni Kullaj and Andi Rraja are in custody, while the owner of the bar Kujtim Përdaku, where the incident took place, has been placed under 'Compulsion to Appear' for failing to report a crime.
Prosecution file:
As stated in the prosecution file, at around 12 o'clock on 06.07.2023 citizen Bilbil Maja, accompanied by his cousin Jashar Maja, were sitting at a table in a bar in Thumana, when they noticed that they appeared there citizens Jelal and Flagur Raja, who were each armed with a pistol-type weapon. When they got close to their table, the file explains that Rrajat told Bilbili to lie down on the floor. At these moments, the latter noticed that four other people entered the bar, among whom he recognized the person who was known by the nickname 'Çaku' and who is the owner of the quarry, which is located in their area. All four people had baseball bats in their hands, and with them they attacked Bilbil, hitting him in different parts of the body.
"From the violent attack and the continuous blows, the citizen Bilibil Maja lost consciousness and was only mentioned when he was in the hospital, where he learned from the medical staff that he had a head fracture. After a few minutes of violent attack, the aggressors, who have increased over time, left the injured lying and left with the means they came with. The injured were transported to the hospital to receive the necessary medical assistance and the citizen Bilbil Maja is in a serious health situation," the investigation file states.
Expertise
In the prosecutor's file, it is clarified that through the data and conclusions of the forensic examination act No. 1620 dated 24.07.2023, it is learned that on the body of the citizen Jashar Maja, a wound was found on the scalp as well as collapse of the soft tissues of the head and body, injuries caused by a strong protective device, which were not dangerous for life at the time of occurrence and as such they fall into the category of those injuries that have resulted in temporary loss of ability to work, to the extent of more than nine days.
"While through the data and conclusions of the medical-legal expertise act 1621 dated 24.07.2023, it is known that, in the body of the citizen Bilbil Maja, a fracture of the frontal-parietal bone of the right side of the head was found, without damage to the brain tissue , wounds on the scalp, fracture of the ulnar bone of the left forearm as well as collapse of the soft tissues of the head and body, injuries caused by a strong sharp tool, which were not life-threatening at the time of infliction and as such, they fall into the category of those injuries, which have resulted in the loss of temporary ability to work, to the extent of more than nine days.
Ndërsa nëpërmjet te dhënave dhe konkluzioneve të aktit të ekspertimit mjeko ligjor Nr 2017 të datës 18.09.2023, mësohet se, dëmtimet trupore të shtetasit Bilbil Maja, te shkaktuara në datën 06.07.2023, të përshkruara me hollësi në aktin e ekspertimit, janë shkaktuar me mjet te forte mprehëse, nuk janë te rrezikshme për jetën e te dëmtuarit ne momentin e shkaktimit, dhe si te tille janë në kategorinë e atyre dëmtimeve që kanë sjelle si pasojë humbje të aftësisë së përkohshme për pune, në masën mbi nëntë ditë. Përfundimisht dëmtimet e shtetasve Bilbil e Jashar, Maja janë konsideruar të tilla, që përkojnë me kriterin mjekësor të veprës penale të ‘Plagosje e lehte me dashje’ parashikuar nga neni 89 i K.Penal e ajo është kryer në bashkëpunim pavarësisht rolit dhe për fshirjes në dhunë të secilit prej pjesëmarrësve dhunues.”, thuhet në dosje.
Arsyetimet e prokurorisë për zbutjen e akuzave
Ndërkohë, në dosjen e prokurorisë thuhet se “gjatë ngjarjes në fjalë shtetasit Flamur dhe Xhelal Rraja, duket se kane përdorur sende që nuk mund t’i konsiderosh si armë zjarri, vetëm për shkak të formës së tyre, të pasqyruar në pamjet e regjistruara apo te stampuara në pamjet fotografike. Sendet në fjalë, nuk janë gjetur në vendin e ngjarjes, apo edhe pas saj, e si objekte materiale, që në vetvete përmbajnë elemente të veprës penale velem në rastin kur konkludohet nga ekspertë të fushës se ata plotësojnë kushtet teknike të armëve të zjarrit. Në mungesë të tyre, nuk mund të vërtetohet fakti kriminal se ato, por edhe të tjerë, plotësojnë kushtet teknike të armëve të zjarrit, apo të ftohtë, por mungesa e një fakti të tille, nuk vë në dyshim bindjen e krijuar tek viktimat e veprave penale, se ato ishin arme të vërteta dhe janë përdorur për të goditur ata, por edhe ju janë drejtuar të dëmtuarve, duke i kanosur seriozisht ata.”, thuhet më tej në dosje.
