Judge Atalanta Zeqiraj has rejected the request to exclude Judge Irena Gjoka from the review of the "Gërdeci" file, where former Defense Minister Fatmir Mediu is accused of the criminal offense of abuse of office.
After reviewing the request, the court ruled that it was filed in violation of the procedural deadlines, therefore considering it inadmissible. According to the decision, failure to comply with the deadline automatically led to the dismissal of the request filed by the defense lawyers.
During the hearing, in front of the judge and SPAK prosecutor Arben Kraja, lawyer Henrik Ligori objected to some of the arguments presented by the Special Prosecution Office.
"The Ministry of Defense is a structure with two heads: a political part and the other part, the General Staff. The people who were responsible for Gërdec have taken their responsibilities. As for the accusation about ammunition, there is no legal act that divides them into large caliber and small caliber. The Minister of Defense is responsible for the policies of the ministry. He cannot be accused of not knowing the calibers, since the General Staff deals with this work. How can a political ministry be charged with technical responsibility? As for the accusation about transportation, it is not the minister's duty, because there are structures that deal with invoices. It seems that the accusation raised by the prosecution is unfounded," said Ligori.
