
SPAK has so far issued 8 arrest warrants for former senior officials of the Ministry of Health for abusing the sterilization concession.
By order of the Special Prosecution Against Corruption and Organized Crime, the former Deputy Minister of Health Klodian Rjepaj and the businessman Ilir Rrapaj were arrested.
For this concession, investigations had been started by the Special Prosecutor's Office, SPAK, after reports that this project is unnecessary, raising doubts about various financial abuses.
In 2015, "SaniService" won the concession for "providing integrated services for the personalized set of surgical instruments, the supply of disposable sterile medical material in surgical rooms, as well as the treatment of biological waste and the disinfection of surgical rooms", with a term of 10 - year old.
The data from the balance sheets show that for the period 2016-2022, the concessionaire's revenues, which are payments from the state budget through taxpayers' money, reached 8 billion ALL, or 76 million euros. (see table).
Excluding two years in which it was at a loss, the concession earned about 7.3 million euros. The profit rate averaged around 15%. The highest profits were achieved in 2018 with 2.5 million euros and 2022 with 2 million euros.
The year with the highest income was 2018, with 1.7 billion lek income, which was much higher than the budget forecast, causing the Ministry of Health to order the restriction of (non-essential) operations to prevent spending beyond the forecast .
The Ministry of Finance, in a 2020 report on the implementation of the concession contract for sterilization, has acknowledged that the funding risk has been taken over entirely by the budget and so far the demand risk and the negotiation risk have materialized, which has caused the budget to pay about 5 million euros more for 2018 alone.
The cost of this concession increased significantly, due to the high number of surgical interventions, compared to the forecasts.
In the draft budget of 2020, in the table clarifying budget funding for concessions, the Ministry of Finance reported that the total value of the contract for the concession of sterilization of surgical tools in the halls will reach 16.5 billion ALL, from 10 billion ALL that was reported in the budget of 2018.
According to the financial report, payments for this contract are made according to the scheme (pay x use), therefore exceeding the number of planned interventions at the annual level brings additional costs to the state budget.
But the data presented by the Ministry of Finance show that the planning was very wrong and the situation got out of control in 2018. "The level of interventions foreseen in the contract is 62,957 interventions, while only for 2018, 117,000 interventions were carried out", the report states.
In 2020, the Ministry of Health concluded a renegotiation process with the company "Sani Servise" in order to reduce the costs of budget payments, which had exceeded the forecasts in the contract because the number of operations carried out in hospitals was higher than predictions.
The Ministry of Finance announced that after negotiations it was agreed with the concessionaire that for all surgical and obstetric-gynecology interventions performed in hospital structures that will exceed the limit of 63,000 interventions per year, a discount equal to 25% will be applied of the price. The discount will be applied starting from the monthly summary bill for the month in which it will result and will be announced by the concessionaire, exceeding 63,000 interventions per year./Monitor
