SPAK dismissed the request for participation in the Assembly, Berisha's

The defense lawyers of the former Prime Minister Sali Berisha appealed to the court against the rejection of the request by SPAK for the participation of the former Prime Minister in parliamentary sessions.

The session for reviewing the appeal of the lawyers of former Prime Minister Berisha will take place today.

On January 19, SPAK rejected Berisha's request to attend the plenary sessions as a deputy.

Please note that on January 18, SPAK prosecutors, Arben Kraja and Enkeleda Millonai rejected Sali Berisha's request to participate in the parliamentary sessions.

In the disclosed decision, it was stated that the Code of Criminal Procedure does not provide for such permission. The prosecutors emphasized that the needs assessed by the court on the basis of which the "house arrest" measure was set must prevail in relation to the tax of the deputy against whom the investigations are conducted to participate in the parliament.

"The legislator has not provided in any of the provisions of the Code of Criminal Procedure or in the provisions of law no. 81/2020 "On the rights and treatment of those sentenced to imprisonment and pre-trial detention" the possibility of granting such a permit."

According to the two prosecutors who made this decision, not even Mr. Berisha's lawyer mentioned any provision on which the request to allow him to participate in the parliamentary sessions was based.

"The legislator has not provided in any of the provisions of the Code of Criminal Procedure or in the provisions of law no. 81/2020 "On the rights and treatment of those sentenced to imprisonment and pre-trial detention" the possibility of granting such a permit."

Former Prime Minister Berisha is accused of passive corruption committed in cooperation with the privatization of the former sports club "Partizani".
