Zenel Çela, senior specialist, Ramiz Bardhi with senior specialist duties and Rexhep Ismajlisufaj with economic duties have admitted their guilt during the investigation phase and based on this situation SPAK has taken them as defendants and sent them to court.
The three defendants, former officials of the municipality of Tropoja, have accepted the authorship of the crime by signing a plea agreement with SPAK, where Zenel Çela agrees to be sentenced to 1 year in prison, but this prison sentence will be converted to two years of probation, where during this time the convicted person not to commit any criminal offense.
The other two defendants, Ramiz Bardhi and Rexhep Ismajlisufaj, have agreed to be punished with the same measure of punishment.
According to the investigation file, the three officials abused during the phase of directing the bid evaluation commission in two tendering procedures announced by the municipality of Tropoja.
The first relates to the reconstruction of the "Asim Vokshi" gymnasium and gymnasium, plus sports fields and external systems with a limit fund of over ALL 53 million.
While the second concerns the reconstruction of the "Tinka Kurti" school in the village of Lekbibaj.
In both of these procedures, the three members of the bid evaluation commission, in unclear and unmotivated conditions, have deliberately excluded the Union of Operators "Halili 1" and "Sëndelli", companies that are managed by Kujtim Byberi and Yzedin Bozhaj.
According to SPAK, the officials of the municipality of Tropoja with their decision have favored the "4 AM" subject owned by Ardit Metaliaj in the reconstruction procedure of the "Asim Vokshi" gymnasium.
In the prosecution file it is stated that:
". ..the bid evaluation commission consisting of Ramiz Bardhi, Senior Specialist chairman, Zenel Çela, Senior Specialist members and Rexhep Isajlisufaj, Economist member, on June 18, 2019, disqualified the Union of Operators "Halili 1" & "Sëndelli", i who participated in the procurement procedure with the object "Asim Vokshi School-Gym and sports fields and outdoor systems in the Asim Vokshi Gymnasium" with a limited fund of ALL 50,319,591, presenting the offer in the value of ALL 42,072,833 without VAT and qualified as the economic operator 4 AM won with the offer of 50,269,533 lek without VAT... ".
But the violations of the three officials of the municipality of Tropoja, have been aggravated even more in the second procedure, that of the reconstruction of the "Tinka Kurti" school in Lekbibaj with a financial value of 186 million old lek.
According to the SPAK file, three defendants initially announced the winner of the Union of Operators "Halili 1" & "Shendelli". Even the legal representatives of the two companies have concluded the contract with the municipality of Tropoja. But in surprising circumstances and causes not justified by law, the disqualification was made.
The following is underlined in the file:
".. .with decision No. 13 of June 18, 2019 BO "Halili 1" & "Shendelli" was declared the winner in this procurement procedure and concluded the contract on June 27, 2019. But later these two companies were disqualified with the argument that " machines and the technical manager, employees, maneuverers stated in this procurement procedure, will be engaged in this contract... ”.
After the exclusion of two subjects in this tender, the members of the Bid Evaluation committee have declared the winner again the company of Ardi Metaliaj, of the subject "4 AM".
The same company that won the reconstruction of the "Asim Vokshi" school, won with the same scheme the reconstruction of the "Tinka Kurti" school in Lekbibaj of Tropoja, dividing the other two entities, "Halili 1" & "Shendelli".
