To avoid direct legal intervention against SPAK, Prime Minister Edi Rama has set up a parliamentary pressure structure, the Standing Committee on Civic Initiatives and Institutional Oversight, headed by Fatmir Xhafaj. Presented as a “collaboration” mechanism, the committee aims to obtain information on SPAK’s investigative files, in violation of its constitutional independence. The case is made even more problematic by the open conflict of interest, as Xhafaj is the brother of Agron Xhafaj, a convicted drug trafficker in Italy and subject to the Anti-Mafia law. While SPAK has publicly rejected this committee, political pressure continues, raising serious concerns about attempts by the majority to control the judiciary.
In order not to enact a law to openly take control of SPAK's activity, Prime Minister Edi Rama created a pressure and attack structure, named the Permanent Parliamentary Committee for Civic Initiatives, Cooperation and Institutional Oversight.
At the head of this commission, he appointed MP Fatmir Xhafaj, the most "guild" and most devoted person to controlling, manipulating, threatening, using and destroying justice, proof he gave earlier with the reform and composition of the leading staffs of justice and vetting institutions.
With the mandate of the chairman of this parliamentary committee, disguised as a "citizen initiative", but which is actually Edi Rama's anti-justice political structure and scheme, Fatmir Xhafaj is sending deputies to the courts, the prosecutor's office and the Court Against Corruption and Organized Crime.
The Special Prosecution Office is the only institution of the new justice system that, with a public stance, did not accept the "Xhafaj" parliamentary commission to monitor its activity, considering this as a violation of constitutional independence.
The scope of work of this parliamentary committee to control the activity and investigative work of SPAK, with the aim of obtaining information on investigative files, constitutes a violation of the Constitution.
But even if this commission were in accordance with the Constitution, it is absurd that Prime Minister Edi Rama and the parliamentary majority have appointed as its leader MP Fatmir Xhafaj, the brother of drug trafficker Agron Xhafaj, sentenced to prison in Italy.
So, the brother of a trafficker, part of an international structured criminal group, heads the commission that aims to control the work of the prosecutor's office investigating corruption and organized crime.
Fatmir Xhafaj is even insisting, through tricks and pressures exerted on behalf of parliament, to definitely control the affairs of SPAK, because, firstly, he has orders from his boss Edi Rama, and secondly, he aims to obtain personal information on investigative files.
With his position as chairman of the commission, Fatmir Xhafaj is in a complete conflict of interest vis-à-vis SPAK, since, due to the conviction of his brother as a trafficker, he himself, as well as his family, is subject to the Anti-Mafia law, with the object of an investigation into property and other aspects.
The surprise in SPAK's stance is the fact that, although it has the criminal file of the chief trafficker Agron Xhafaj, it is not seizing the unjustified assets and is not launching an investigation into the assets of his family members, including Fatmir Xhafaj, his wife, daughters and son-in-law./ Pamphlet
