For more than a year, communication between the director of the National Bureau of Investigation (BKH), Aida Hajnaj, and the head of SPAK, Altin Dumani, has been limited only to the formal exchange of letters through secretaries, e-mails, and official mail.

The reason for this situation is the ongoing dissatisfaction of BKH investigators with the way SPAK prosecutors handle investigative matters. SPAK prosecutors are accused by BKH of truncated charges, lack of orientation of investigations towards real criminal offenses, as well as the exclusion of certain subjects and persons from investigations due to political and clientelistic connections.

One of the main cases that has culminated in the conflict between Hajnaj and Dumani is the file of builder Fatmir Bektashi, who is under investigation for economic and financial crimes and is currently under the light security measure, "Compulsory appearance."

BKH investigators submitted to prosecutors Arben Kraja and Enkeleda Millonai extensive evidence identifying Bektashi as the key figure in a wide-ranging fraud and money laundering scheme in collaboration with Jamarbër Malltez and Xhimi Begenë, particularly in relation to the “Partizani” towers.

According to the BKH, Bektashi is accused of concealing over 110 million euros in income from the sales of apartments and commercial units through double contracts, falsification of documents, tax evasion and theft of public property.

However, prosecutors Kraja and Millonai, according to BKH reports, have ignored the evidence collected by investigators and have removed key elements from the investigation file, seeking a mitigating measure for Bektashi.

Aida Hajnaj has officially reacted against this action, requesting clarification from the head of SPAK, Altin Dumani. However, the latter has supported the decisions of SPAK prosecutors by taking a file to court "cleared" of serious charges.

The clash between the two leaders has intensified again during the investigation of another file related to the mayor of Tirana, where prosecutor Ols Dado is also accused of eliminating evidence that seriously implicates Fatmir Bektashi.

For these cases, the director of the BKH, Aida Hajnaj, has officially reported to the High Prosecutorial Council, the High Inspectorate of Justice and the FBI staff at SPAK, including not only the Bektashi case, but also 33 other cases of favoritism of senior officials, politicians and oligarchs by SPAK prosecutors.

The question that still remains unanswered is what "magic" saved Bektashi from the measure of arrest, given that the Criminal Code clearly stipulates that for crimes of this nature the measure of "Arrest in prison" should be applied./ Pamphlet
