Marjo Përlleshaj, convicted of the murder of Martin Cani, has appealed the first instance decision to the Court of Appeal, which sentenced him to 16 years in prison.
His defense attorney disputes the legal qualification of the criminal offense as "murder under qualifying circumstances," for which the sentence was given. According to the defense, this charge should not be aggravating to the minor, since the incident, according to them, occurred in conditions of self-defense and under the effect of a strong psychological shock.
These arguments were also presented during the trial in the first instance, but were not taken into account by the trial panel, which decided to find him guilty and sentence him to 16 years in prison.
On December 9th of last year, the Court of First Instance sentenced Përlleshaj to 12 years in prison for the murder of Martin Cani and 10 years for the attempted murder of another minor. When the sentences were combined, he was ultimately sentenced to 16 years in prison.
The serious incident occurred on the premises of the "Fan Noli" school, where a conflict between minors escalated into the use of a cutting tool. As a result, Martin Cani lost his life, while his friend, Luis Mecaj, was injured and transported for medical assistance.
After the investigation was completed, the Prosecution filed charges of murder and grievous bodily harm, seeking the maximum sentence for the defendant. However, the court imposed a lower sentence than requested by the prosecution. After the incident, additional security measures were taken at the school, while the government decided to close the social network TikTok.
