Democratic leader Sali Berisha considered the decision taken by the KAS to be completely legal, rejecting the complaints of 4 DP candidates for MPs who requested a recount of votes in the Durrës and Tirana Regions.
Berisha explained that since 2019, an amendment to the Electoral Code, supported by the Venice Commission and ODIHR, has removed the right of candidates to file complaints of this nature.
"The Venice Commission, ODIHR and our code recognize this right for political entities."
Political entities are also invested in the candidate.
These honorable candidates have followed an advised path, I cannot say because our representatives have also made clear to them the interpretation of my call, which they must make through the party, but within the platform approved by the party.
In what sense?
If the party has requested the illegality of the elections, the first request that is considered is illegality.
After that, the party receives and presents the candidates' requests one by one.
Several candidates who have requested a recount have filed their applications with party representatives at the CEC and are awaiting the moment of the party's evaluation for District X, after which their complaints will be submitted.
Even for the Tirana candidates, they were informed again yesterday that the path they have followed is one that has no legal support.
Our representatives at KAS have enforced the law.
They could not vote for an act that was repealed by law.
These four have the right to file our complaint with our representatives at the CEC and they will present the request to the CEC as they wish.
So, it was just a misunderstanding on their part.
"If I have said twice that any candidate who thinks they need transparency will be supported by the party, they must respect this platform that the party has defined in accordance with the electoral law," said Berisha.
