Holta Zaçaj, president of the Constitutional Court, during her speech at a solemn session on the occasion of the 25th anniversary of the Constitution of Albania, focused on criticism from the opposition, against former Prime Minister Berisha, towards the judicial system.
According to her, criticism is an indicator of freedom of expression, but to the extent that it does not turn into an attack or a means of pressure on them. She emphasized that the judiciary can play its constitutional role only if it is independent.
"The Constitutional Court, which has been entrusted with the responsibility of being the guardian and interpreter of the constitutional norm, is called upon to say the last word whenever necessary. This is a mission and role that constitutional judges carry with great pride and responsibility. Through interpretation, the Court succeeds in making the constitutional norm a reality, alive. In the interpretation of the Constitution, it respects our national values as part of universal values, taking into consideration the intention of its drafters, as well as adapting to new social dynamics.
During the three decades of its operation, the Constitutional Court has influenced the development of democracy and constitutional justice, responsible for the impact of its decision-making on the social, economic and political life of the country. Regardless, all actors must accept her verdict. The implementation of the decisions of the Constitutional Court is in fact the correct, necessary and only behavior to implement the Constitution.
Criticism of the Court and its judges is an indicator of freedom of expression, for which we all fought, but to the extent that they do not turn into an attack or a means of pressure on them. Let's not forget, the judiciary can play its constitutional role only if it is independent. The politicization of the judiciary and the judicialization of politics have been and are phenomena, which constitute constant challenges of developing democracies, but also of consolidated ones", said Zaçaj .
