
The Special Prosecutor's Office rejected Sali Berisha's request to participate in Parliament. Two days ago, the former prime minister asked for permission with the argument that he would represent the voters in the task they entrusted him with, but SPAK refused.
SPAK has also listed the reasons why Berisha is not allowed to be released from custody.
In SPAK's letter, the fact is mentioned that for the duration of house arrest, the rules set for detention apply.
"Under these conditions, even the right to practice the profession, or even the mandate gained from the elections to the Assembly, should be considered as incompatible with the implementation of the security measure "house arrest", provided by Article 237 of the Criminal Code .Pr.Penal, just as it is incompatible for any other citizen who is subject to this measure, the right to go to work.
In the case of other coercive measures, such as the obligation to appear before the judicial police, it is established that the right to exercise the profession is in accordance with the type of measure, since the person is not forced to stay in his home.
Under these conditions, the needs assessed by the court, on the basis of which it assessed the determination of the security measure "house arrest", provided by Article 237 of the Penal Code, should prevail, in relation to the deputy's tax against whom investigations are carried out, to take part in the work of the Assembly." says SPAK.
For 22 days, the leader of the opposition has been under house arrest due to investigations into the "Partizani" file. If he does not go to the Assembly for six months, his mandate is burned. Next week he will be questioned for the first time by SPAK.
