Constitutional Court overturns Meta, sees no irregularities in imposing "prison arrest" measure for former president...
Former President Ilir Meta seems to be in isolation for a long time.
After being left in prison by the GJKKO, the Appeals and the Supreme Court, Ilir Meta took the final step by addressing the Constitutional Court, claiming irregularities in the process against him. The Constitutional Court met today to review his request and in the end, by a majority vote, it was decided to reject the request, deciding that Meta will continue to remain under the security measure of "prison arrest".
Meta has also raised as a claim the way in which the security measure was executed, but according to the Constitutional Court, the former president has also presented this argument in other courts, and according to the court, he has filed a report for the commission of arbitrary actions in the Tirana prosecutor's office and the matter is under investigation. On this issue, the Constitutional Court, by majority vote, did not consider this point, since the other courts have not expressed their opinion.
After this step, Meta has exhausted all levels of appeal in the country and now he will most likely turn to Strasbourg, as the last step that could bring freedom. But until the decision is made there, it seems that Meta will spend a long time in prison, also due to the fact that the file has just gone to trial.
Ilir Meta is under indictment for corruption, money laundering and concealment of assets. He is accused of involvement in the CEZ-DIA case, as well as lobbying and family expenses. Monika Kryemadhi is also accused, who faces charges for three corruption cases, including expenses for cosmetic procedures.
The file also includes Pirro Xhixho, whom SPAK suspects of having abused his position as chairman of AKEP, proposed by the LSI, by allegedly influencing the leaders of a mobile phone company to conclude an interconnection contract for the transfer of telephone calls, in accordance with orders received from Meta and Kryemadhi.
Constitutional Court decision
The Constitutional Court of Albania (Court) on 08.04.2026 considered in a plenary session, based on documents, the case with the applicant Ilir Metaj, with the subject: Annulment of decisions no. 125, dated 20.10.2024 and mr. 130 dated 23.10.2024, of the Special Court of First Instance for Corruption and Organized Crime, no. 59 (87-2024-333), dated 19 11.2024 of the Special Court of Appeal for Corruption and Organized Crime and no. 00-2025-364 (57) dated 27.02. 2025 of the Criminal Chamber of the Supreme Court as incompatible with the Constitution of the Republic of Albania.".
The Court, after considering the claims and objections of the parties, in summary, notes the following:
Së pari, kërkuesi legjitimohet ratione personae dhe ratione temporis për vënien në lëvizje të kontrollit kushtetues për vendimet gjyqësore që kanë disponsar ndaj tij masën e sigurimit personal "Arrest në burg".
Së dyti, sa i takon kriterit për shterimin e mjeteve juridike, kërkuesi ka pretenduar cenimin e së drejtës për të mos iu nënshtruar tortures, mint apo trajtimit mizor, çnjerëzor ose poshtërues, të garantuar nga neni 25 i Kushteturnés de neni 3 i KEDNJ-së, lidhur me ngjarjen e datës 21.10.2024 për mënyrën e ekzekutimit nga Policia e Shtetit të masës së sigurimit "Arrest në burg", në zbatim të vendimit nr. 125, datë 20.10.2024 të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar.
Gjykata konstatoi, nga njëra anë, se kërkuesi e ka parashtruar këtë pretendim në gjykatat e juridiksionit të zakonshëm në procesin gjyqësor për verifikimin e kushteve dhe kritereve të caktimit të masës së sigurimit personal dhe nevojave të sigurimit, ankimin dhe rekursin e tij dhe, nga ana tjetër, se autoritetet shtetërore kompetente nuk kanë vepruar në atë kohë me nismën e tyre për të adresuar pretendimet e kërkuesit.
Megjithatë, sipas informacionit të përcjellë nga Prokuroria pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Tiranë kërkuesi ka paraqitur kallëzim lidhur me ngjarjen dhe pranë asaj prokurorie në vitin 2025, duke u regjistruar procedimi penal për veprën penale "Kryerja e veprimeve arbitrare", të parashikuar nga neni 250 i Kodit Penal, për të cilin hetimet janë në vijim. Në kushtet kur nuk ka ende një vendim përfundimtar nga gjykatat e zakonshme mbi këtë çështje, Gjykata, me shumicë votash, vlerësoi se nuk mund ta marrë në shqyrtim duke qenë se kontrolli i saj ka natyrë subsidiare, në kuptim të nenit 131. shkronja "f", të Kushtetutës.
Thirdly , in terms of the ratione materiae criterion, the Court focused on assessing the applicant's arguments regarding the infringement of personal freedom in the substantial aspect related to (1) the standard of reasonable doubt based on evidence and (ii) the principle of proportionality, guaranteed by Articles 17, 27 and 28 of the Constitution. The court, by majority vote, assessed that: in the criminal case against the applicant, there appear to be facts and information that would convince an external observer that the applicant may have committed the criminal offenses of which he is suspected, therefore it cannot be concluded that the restriction of his liberty was carried out in the absence of reasonable suspicion, within the meaning of Article 27, paragraph 2, letter "c", of the Constitution and Article 5, paragraph 1, letter "e", of the ECHR, the personal security measure against the applicant is imposed for a legitimate purpose, guaranteeing the proper conduct of the criminal proceedings against him, it is not disproportionate in the context of the circumstances of the case and the security needs, and is in accordance with the procedural rules of the CPC for its imposition.
At the conclusion of the examination of this case, the Court decided, by majority vote: To dismiss the request.
