Lawyer Romeo Kara has spoken about the arrest of lawyer Ulian Barjami, after a clash with prosecutor Gjergji Ceka during a court session at the Elbasan Court.
The lawyer said he sees the lack of equality in the courtroom between the prosecution and defense parties as a concern.
He added that in such cases there could be a warning or a fine, but not arrest.
" There is no equality in the courtroom between the prosecution and the defense, which are the lawyers, sometimes they listen to what they have to say and sometimes they don't, and in many cases they don't even let them speak. Yes, the Bar Association should have reacted faster. For me, the lawyer shouldn't have said what he said, "I will deal with you personally," because this could be taken as if he had it outside the process.
But in such cases the court speaks, it warns, but it is the court that should have intervened and managed the situation. So there is a warning, expulsion, fine. To me it seems more like stubbornness on the part of the parties who should have been clarified. In the courtroom it is not simple, it is good for the lawyer to put himself in the role of the client but not to experience the event so much. The lawyer must put himself in the place of both the judge and the prosecutor ," he said.
The lawyer also commented on the initiation of proactive verifications by the High Inspectorate of Justice, regarding the case of the detention of lawyer Ulian Barjami.
"Why are they reacting now? I have submitted irrefutable files and they reacted after a few months, saying there was no violation. We do not have justice institutions. Justice is at its weakest point. They do not close their eyes when there are billions of euros today. These are institutions that are not only formal but are like thorns in the flesh that hinder you. Where were these before, why did they not react ," he said.
Kara also touched on the race for the new head of SPAK. He said that two of the most advantageous names, according to him, are Adnand Xholi and Klodian Braho.
" The visit that Altin Dumani made to the US gave the message that we support Dumani until the end and SPAK, if they want a continuation I say that two of the names are Braho and Xholi, they have not mentioned names but that is how I read it. SPAK will be supported even more than before by the US and we will very soon have some actions from SPAK for political figures during these two months ", he said.
