The court session for the former Minister of Defense, Fatmir Mediu, is postponed due to the absence of two lawyers.
The next senaca will be held on November 30 at 10:00. The court reassigned the lawyer, mainly Artan Simon.
The media is under investigation for the "Gërdec" case. A few days ago, the former minister said that justice can never be fair, if it commits a new injustice, while accusing the judicial process, which it calls illegal.
At the session of the criminal process in charge of the former Minister of Defense, Fatmir Mediu regarding his responsibility in the tragic event of Gërdec, held on Wednesday, October 18, 10 of the witnesses called by the prosecution presented their statements.
The witnesses were injured by the March 15 explosion in Gërdec, who were able to survive, as well as family members of the victims. First, the spouses Feruzan and Zamira Durda, the parents of a 6-year-old boy who lost his life in the explosion while playing with his cousins, were asked. Also, witnesses Drita Cani, Alketa Hazizi, Fejzi Shehu, Elidon Durda, Mustaf Laçi, Hekuran Kasa, Koli Hazizaj and Hekuran Deliu were questioned.
The questions of the prosecutor Klodian Braho and the lawyers focused mostly on the way the witnesses or their family members were employed at the weapons dismantling site in Gërdec, the conditions in which they worked, who directed them, whether the process had been supervised military forces, as well as what circumstances they remembered from the moment of the explosion, where and how it happened.
The witnesses brought the panorama of the tragic event after 15 years. Those who were not at the scene told how they had learned about their injured family members or those who had lost their lives.
In all the questions, the witnesses stated that they knew that the carts that were damaged were welded by the citizen Qemal Deliu, in his house, which is located near the place where the weapons were dismantled. Although one of the witnesses stated that he had seen a cart being transported for welding and returned shortly before the explosion, Deliu's son stated that his father took the damaged carts home in the evening, when he also welded them and returned them to morning. He stated that on that day, before the explosion, he had been in the garden of the house working the vineyard and that the father had not gone to weld any cart.
Some parts of the witnesses' statements were opposed by the legal representatives of Mediu and the prosecutor Braho, with the argument that they were not the same as what they had declared 15 years ago, in function of the Gërdec case.
Judge Irena Gjoka drew the attention of Mediu's lawyers for the way of presenting some of the questions addressed to the witnesses. Also, he did not accept some questions and asked the witnesses not to give answers.
The lawyers asked at the beginning of the session to submit a request regarding the witnesses called by them, but the court asked them to submit the written copies and submit them at the next session.
In the end, there were discussions between the court and the defense attorneys about scheduling the next hearing.
The reopening of the case against Mediu was initiated after 12 years by the initiative of the family of one of the victims of the explosion in March 2008 in the premises of the former "Tank Brigade", with 26 lives lost and hundreds injured. According to the petitioners and SPAK, after the legal changes of 2012 and 2017, the deputy no longer has parliamentary immunity for criminal prosecution or his trial and therefore there is no obstacle for the investigation and trial of Mediu who is accused of "Abuse of duty".
