For the continuation of the investigations in the Oncology file, the special appeals court left SPAK as an immediate task to analyze the eventual responsibilities of the director of the Oncology hospital.
In the leaked decision that Top Channel has exclusively, Judge Florian Kalaja reminds the Special Prosecutor's Office that apart from the 7 people who are being investigated, among them doctors and pharmacists, it should be investigated whether or not the head of Oncology, Silvana Celiku, has taken measures to administer the hospital from criminal abuses says the personnel judge. It will be further investigated whether or not the director has submitted reports to the judicial authorities.
In the divulged decision, the judge of the special appeal also talks about corruption, which, according to the judge, should be seen in what form of cooperation was carried out and in what period of time.
Seeing them as concerted actions aimed at intimidating patients with tumor diseases to send them to private clinics like the one owned by the investigator Edmond Gashi, the appeals court says that the recorded cases should be classified as fraud.
Exploiting the fear of patients and family members created by the tumor disease and using it for profit purposes according to the judge is a situation of fraud to appropriate the wealth of the victims.
In making the decision, the court refers to the complaints of some of the investigators who asked for a change of measures such as Edmond Gashi, his father Halil Gashi, pharmacist Florian Markut and former hospital official Brikena Qiriazi.
For the former deputy director of Qiriazi Hospitals, the appeal removed the security measure, drawing the attention of SPAK and the Prosecutor's Office of Tirana that they have not conducted sufficient investigations to prove that the source of Cobalt has been mismanaged by the hospital.
