Ilir Meta, former President of the Republic, through his lawyer, Kujtim Cakrani, requested the change of the security measure of "prison arrest", also referring to the unifying decision of the Supreme Court on pre-trial detention.
Although Meta was not present in the GJKKO courtroom, lawyer Cakrani said that based on this unifying decision of the Supreme Court, the Prosecution is obliged to first evaluate alternative measures and argue with evidence the need for an individual to remain in detention.
According to him, Ilir Meta "is not at risk of escaping or of destroying evidence, including the fact that there are no protected witnesses in the case, which could weigh on his position."
"The court must foresee the circumstances and the dangerousness of the individual, the court must justify why an individual is being held in custody. The High Court acquitted Mirlinda Karcanaj, who is accused of a criminal group, while Meta has been held in custody for 19 months ," the lawyer stressed. Unlike the lawyer, SPAK has requested that the GJKKO not change the security measure. SPAK's prosecutor, Sotir Kllapi, reads the Supreme Court's decision differently, shifting the burden of proof to the defense. He said that the lawyer did not present any evidence for replacing the measure, so he assessed that there are no circumstances to change it.
"The Supreme Court's decision does not bring anything new to this process," the prosecutor said.
Supporting Meta in the courtroom were the Secretary General of the Freedom Party, Tedi Blushi, and Democratic Party MPs, Flamur Noka, Klevis Balliu and Bujar Leskaj.
