Confidential sources from the Ministry of Finance have informed the "Pamphlet" that the Secretary of the Prime Minister's Office, Angel Agaçi, has sent Minister Ervin Mete an internal action order regarding the information and documents that will be required by the justice bodies. .
According to the information, this order has been sent to all the ministers, who must issue sub-orders for the central directorates, public entities and agencies and municipalities under their authority, but it has also been sent to the agencies and inspectorates under the prime minister.
Specifying the SPAK, the BKH and the Special Court, which have the competence to deal with the corrupt affairs of officials, "Don" Agaçi has ordered the ministers, starting from February 1, 2024, for the information requested by these two justice institutions , to act according to the practices of Law No. 119/2014 "On the right to information".
With this law, answers to information and official documents requested by citizens, media, associations, lawyers, experts and businesses are dealt with; to whom they are not given at all, or are deliberately delayed, so that they do not use them in court cases when they should, and do not publish them in time.
With the order given by Engjëll Agaçi, "de facto", ministers and through them the heads of government institutions and entities are ordered to delay any information and official documents that will be requested by BKH, SPAK and the Special Court during investigative and judicial processes.
According to the Annex of the Constitution for the bodies of the new justice, and according to the law on the functioning of the BKH, SPAK of the Special Court, all state institutions from the top of the state to the local bodies, have the obligation to give them, in the deadline they request, any information and official document.
But Babloku, through his Angel, has decided to deliberately block and delay the information and documents that will be requested by BKH, SPAK and the Court, ordering the ministers to deal with Law No. 119/2014 "On the right to information" .
In addition to the blocking delays, with this Bablok order, the agents of the National Bureau of Investigation are deprived of the right to seize documents directly, as determined by the Code of Criminal Procedure in the section on SPAK.
Because, with the internal order, they must make a prior request to seize official documents and equipment, although the law gives them the unlimited right, to make direct seizures without warning, with a court decision.
So, it must be announced and requested in advance, so that the "ustallars" of the prime minister, ministers, directors and mayors have enough time to hide and clean files and computers from evidence of crimes.
