Parliament's recommendations for the Special Prosecution Office are revealed...

The full resolution of the Assembly on the Special Prosecution Office (SPAK) is published, with the aim of strengthening inter-institutional cooperation and increasing efficiency in the fight against corruption and organized crime.

The document, which was provided by "Pamphlet", contains a series of recommendations, among which the most important are the identification of active criminal groups and the evaluation of security measures implemented in recent years. It passed the Laws Committee and is expected to be approved at Thursday's session, where Altin Dumani will report.

In one of the key points, the Assembly requests the establishment of a working group in cooperation with the General Prosecutor's Office, SHISH and other law enforcement agencies, to prepare a complete analysis of organized crime groups, their activity inside and outside the country, as well as the drafting of an in-depth strategy to combat them.

Another important element of the resolution is the request for the preparation of an analysis of the security measures taken during the period 2021–2025. So it seems that the majority continues to pressure SPAK to curb arrests. Although it was once stated why SPAK does not arrest, now softer measures are requested. This point comes within the framework of several previous requests, especially after the arrest of Veliaj, where SPAK was criticized for its restrictive measures with prison.

The resolution also calls for closer cooperation between justice institutions and security structures to prepare new policies, including the analysis of electoral crimes, improving financial investigations and standardizing investigation methodologies. It also foresees the wider use of advanced technologies for asset tracing, money laundering and cybercrime.

In conclusion, the document emphasizes the necessity of increasing the efficiency of the National Bureau of Investigation and of deepening SPAK's international cooperation with partner agencies such as Europol, Eurojust and OLAF, in accordance with European Union standards and the recommendations of monitoring structures.

Resolution for SPAK

Considering the constitutional mission of the Special Prosecution Office in the fight against corruption and organized crime to be extremely important;

recognizing, respecting and supporting the legal and institutional independence of the SPAK structure; including the Special Prosecution Office and the National Bureau of Investigation; appreciating its important role in the exercise of criminal prosecution, investigation and representation of the accusation on behalf of the state before the first instance court against corruption and organized crime, the Court of Appeal against corruption and organized crime, as well as the Supreme Court.

Also, appreciating the commitment and results achieved by the Special Prosecution Office and the National Bureau of Investigation throughout 2024, in fulfilling their constitutional and legal responsibilities and in implementing previous recommendations of the Albanian Parliament; taking into account the increased trust of the public and international partners, as well as the positive assessments expressed for the activity of this institution by the European Union, also within the framework of the country's EU membership process.

After listening to and discussing the report presented by the head of SPAK, we present the following recommendations for the special structure:

1. Establishing a working group in cooperation with the General Prosecutor's Office, SHISH and other law enforcement agencies, to prepare an analysis of organized crime groups active domestically and abroad and to draft an in-depth strategy to combat them.

2. It is also required to prepare an analysis of the security measures taken during the years 2021-2025, the policies followed, the problems identified and the necessary measures for improvement, based on the practices of European countries and the standards recommended by the ECHR, the EU, GRECO, the Constitutional Court and the Supreme Court.

3. In cooperation with the Office of the Prosecutor General and the Central Election Commission, a joint analysis should be developed on the implementation of the strategy for the prevention of electoral crimes for the upcoming elections, as well as on the legal and institutional measures that can be taken to guarantee the integrity of electoral processes and to punish any violation of the law in this area.

4. It is also recommended to expand the use of advanced technologies for tracing assets and financial networks in cases of organized crime and corruption; increase technical and logistical capacities for financial investigations; improve the investigation of cybercrime and money laundering, including cryptocurrencies; specialized training and closer cooperation with Europol and IMPACT.

5. Efforts should be made to unify and standardize the investigation methodology regarding the collection of evidence and security measures, based on the decisions of the Supreme Court, the Constitutional Court and the ECJ.

6. The finalization and approval of the remaining bylaws is also required, including the roadmap for reducing backlogs and acts related to the internal circulation of files.

7. Effective implementation of the case management system should include activating the remaining modules and using the system for internal reporting and generating real-time statistics.

8. The aim should be to increase the institutional efficiency of the National Bureau of Investigation, in accordance with the provisions of the organic law, by filling vacancies and ensuring logistical conditions for the full functioning of the structure.

9. It is also requested to continue efforts to deepen international cooperation, in implementation of EU recommendations, by intensifying cooperation with European Union agencies such as Eurojust, Europol, OLAF and member states in pursuing transnational cases, with the aim of fully fulfilling the recommendations of the European Union Report, GRECO and MONEYVAL. / Pamphlet
