The Democratic Party of Reestablishment has requested the exclusion of the judge of the Constitutional Court, Marsida Xhaferllari, from the case filed by the opposition MPs regarding the "Rama-Meloni" pact for immigrants. This request comes after the publication of images where judge Xhaferllari celebrated together with her partner Enkelejd Alibeaj at the political party organized by Lulzim Basha for the end of the year.
In the request of the chairwoman of the DP Appeals Committee, Adriana Kalaja, it is emphasized that Marsida Xherllari is in a conflict of interest with the group of DP deputies, led by Gazment Bardhi, and according to her, she should be excluded from judging the case.
"It is enough to verify the decisions made by Mrs. Xhaferllari in the last months you will understand that we are facing a serious abuse of office. Thus, actions in violation of the Constitution and the law are aggravated by Mrs. Xhaferllari, in the case of the decision of the Constitutional Court dated 22.12.2023, where the request of the group of deputy Basha, which is part of the deputy Alibeaj, or the co-habitant of the one referred by me, Mrs. Xhaferllari, and the latter, not only does not resign, as stipulated by the legal provision, but also acts as a relator in this trial", the request states.
Castle emphasizes that it has addressed a request to the Special Board of Appeal as well as to the High Inspectorate of Declaration and Control of Assets and Conflict of Interests, to make available the following violations by the member of this court, Mrs. Marsida Xhaferllari.
Citing the Law on the Prevention of Conflict of Interests in the Exercise of Functions, Kalaja requests in the letter addressed to the President of the Constitutional Court Holta Zacaj, the exclusion of judge Marsida Xhaferllari, from the issue of reviewing the pact with Italy for immigrants requested by 30 deputies of the Democratic Party. because of the conflict of interest she has with the group of deputies of the Democratic Party.
The session of the Constitutional Court for the "Rama-Meloni" pact is scheduled to be held on Thursday, December 18 at 10:00.
