"Balluku" case, Constitutional Court to meet tomorrow for Prime

The Court's College will meet on Thursday to schedule a hearing on Prime Minister Rama's lawsuit regarding the suspension of Deputy Prime Minister Belinda Balluku.

At this meeting, the three constitutional judges verify the criteria of the lawsuit, whether they are met or not, in order to take the matter to the next Judges' Meeting.

Among the three judges is Sandër Beci, who has been appointed rapporteur for the prime minister's lawsuit in the Balluku case and is preparing the documentation for the panel of judges.

According to ABC News sources, the fastest hearing is expected to take place on December 2, Tuesday of next week.

At this meeting, the judges must express their opinion on the Prime Minister's request to lift the suspension measure against Deputy Prime Minister Balluku, who is also the Minister of Infrastructure and Energy.

As in the submitted Constitutional request, the government has argued that this measure against Balluk hinders the activity of the Council of Ministers. After Rama, only the Deputy Prime Minister can sign the acts that are approved by the Council of Ministers, in the absence of the Prime Minister.

The lawsuit also states that the Special Court has interfered with the powers of the Prime Minister, obstructing the work of a member of the Council of Ministers who enjoys immunity just like a deputy.

The Prime Minister has described the GJKKO decision on Balluk as unconstitutional as it violates the guarantee of immunity of the Council of Ministers, violates the principle of separation of powers and hinders the activity of the Council of Ministers, as well as interferes with the powers of the constitutional bodies that carry out the proposal, appointment and approval of the acting minister. Based on these arguments, the government is requesting the Constitutional Court to annul the measure of the Special Court on the Deputy Prime Minister. / ABC News
