The appeal to the Constitutional Court against the dismissal from the Municipality of Tirana is the first act of Erion Veliaj's rebellion against Edi Rama, an action that keeps Tirana in suspense, without a mayor and without elections.
Erion Veliaj today appealed the decision of the Council of Ministers to dismiss Edi Rama, thus suing his former political boss in the Constitutional Court.
Immediately after this move by Veliaj, the draw was made at the Constitutional Court.
Judge Sonila Bejtja has been chosen as the rapporteur for the case.
Veliaj argues that the dismissal is unreasonable and that there is no proven serious violation to justify the extreme measure of removal from office.
"Any attempt to read Article 62 of the Law "On Local Self-Government" as creating a new category of dismissal outside the constitutional framework would in itself be an interpretation that cannot be made, because it is an unconstitutional interpretation."
The argument the Municipal Council used for his dismissal was his absence for a period of more than 3 months, which, for Veliaj, does not hold true.
"In the case of the Mayor of Tirana, the absence was the result of a security measure, i.e. an objective impossibility, and moreover, the continuity of the function was ensured through the appointment by the Mayor of the deputy mayor who would exercise the mayor's powers. So, fundamentally there was no "serious violation"."
On September 11, Rama announced Veliaj's dismissal and at the same time nominated Ogerta Manastirliu as his candidate. Six days later, on September 17, SP councilors lined up with their signatures under pressure to seal what became a fact on September 23, when the municipal council, in alliance with the DP, voted to dismiss the mayor.
The Constitutional Court has a maximum deadline of 4 months to make a final decision on the constitutionality of the dismissal, but if the case is considered urgent, it can be reviewed even earlier. And it seems that the case will be treated with priority, since the draw was made within a day of Veliaj's appeal.
Meanwhile, the process remains under the attention of public opinion and political actors, while the next step from the Council of Ministers is awaited with interest, which still has the decision on the vacancy in the Presidency in hand, a step that would then lead to the decreeing of new local elections by the President of the Republic.
