The US ambassador to Kosovo, Jeffrey Hovenier, in a press conference, said that there is urgency from the European Union countries for the formation of the Association of municipalities with a Serbian majority.
According to him, the draft has been reviewed by the EU and the USA and has been prepared in order to be in full compliance with the Constitution of Kosovo.
Hovenier has said that the US has continuously emphasized that the Association must be in accordance with the current Constitution of Kosovo and no constitutional changes should be requested.
"It must be in accordance with the current Constitution of Kosovo, the decisions of the Constitutional Court and it must not have executive power. It should not be another layer of governance. It must be consistent with the views we have expressed in the January article by advisors Derek Chollet and Gabriel Escobar," he said.
He said that they believe that this draft statute that was given to the Government of Kosovo meets all these criteria.
According to him, only one entity can decide whether it is in accordance with the Constitution of Kosovo or not, and that is the Constitutional Court.
Hovenier has said that as Prime Minister Albin Kurti said in the Assembly in September, one of the provisions in this draft statute is that it will go to the Constitutional Court.
"All these questions, almost hysterical comments about its constitutionality seem inappropriate to me. After careful work has been done to draft the statute and articles have been established to ensure that a body in Kosovo that has the ability and authority to establish constitutionality, the Constitutional Court will do so before it enters into force," he said. he.
He has said that there is no secret about the draft of the Association, but according to him, sometimes diplomatic negotiations require secrets when it comes to something sensitive, since according to him, it is more appropriate to reach an understanding between the parties.
"Regardless of whether it is about the agreements in the dialogue, whether it was about Rambuje, about the negotiations for Ahtisaari, or other things. There is a time when things are made public and when confidentiality is needed. At an appropriate time, the public will have the opportunity to evaluate the draft statute. That time will be determined by an appropriate combination of governments and Miroslav Lajcak," he said.
While talking about the deadline for its implementation, he said that the EU countries have it urgently.
According to him, there is no reason why the Government should not move forward with this draft statute.
Hovenier said that it is not only the Association that must be implemented, but all the obligations obtained from the basic agreement and the implementation annex in Ohrid must be implemented.
"If you read the statements of the German chancellor, the French president, the prime minister of Italy, I must say it is extraordinary that these high European leaders are directly involved in this process to help Kosovo move forward on the European, Euro-Atlantic and normalization path. of relations with Serbia, which is to the benefit of both countries. They use words like urgent, as soon as possible and things like that. There is urgency, there is a desire to be seen to move forward. It is part of our talks with the Government now. There is no reason why the Government of Kosovo should not proceed with this draft statute. The Prime Minister expressed his willingness to accept it in its entirety only a few weeks ago. We are working to see it become an element of our broader strategy. It is not only the Association, nor can it be. All obligations received by Kosovo and Serbia with the Basic Agreement and the implementation annex in Ohrid must be implemented. We want to see this", he declared.
Hovenier said that the US strongly believes that the Association of Serb-majority municipalities should be in accordance with the current Constitution of Kosovo, should be formed based on the decision of the Constitutional Court and should not be a new layer of power, and not should have executive power.
