109 thousand trials blocked in the courts, the Constitutional Court issues a decision: Parliament should find a solution

The Constitutional Court has spoken about the stock of files that has affected all levels of the judiciary and that has reached 109,000 pending cases.

After considering the lawsuit of a citizen who has been waiting for 5 years, the Constitutional Court considers the delays unreasonable and deems legislative interventions necessary.

"Judgment beyond a reasonable time, based only on the fact that the state has failed to take efficient measures, cannot justify the violation of the constitutional rights of individuals, in the conditions where the overload in the courts is already a known and prolonged situation, which does not depend on individuals. At this point, the Court notes that the behavior of the state authorities, in particular those who approve the laws and policies of the justice system, is not at the appropriate level of efficiency, as it necessitates further interventions, especially legislative ones, to avoid delays unreasonableness of judging cases in the courts, in the conditions when the existing legal means do not respond to the current situation" , declares the Constitutional Court in the decision made available to Top Channel.

Legislative intervention was proposed a year ago by the KLJ.

However, the Constitutional Court adds that this situation has been going on for several years and the methods identified by the courts themselves and the Supreme Judicial Council, which has the responsibility to ensure the smooth functioning of the judicial power, show that the provided mechanisms serve a normal period of judicial activity . The Constitutional Court upheld the request of Laureta Selimaj and ordered the administrative appeal court to examine her case with priority.
