At a time when justice reform aims to restore citizens' trust in institutions, any procedure for appointments to the top of the judicial system is expected to be transparent, verifiable and based on the highest professional standards.
However, names linked to politics and organized crime are being placed at the head of the judiciary. This is due to the fact that Valbona Sanxhatari's dark connections with the underworld are suspected to be evident even today.
In this context, the list of candidates for a seat on the Supreme Court also includes the name of Valbona Sanxhatari, a figure who has held various roles in important state institutions in recent years and who is undoubtedly considered a figure politically connected to the Socialist Party. Also, her suspected links to organized crime make her selection as head of the Supreme Court questionable, not only from a political perspective, but also because it raises doubts that a member of the Supreme Court could be selected under the influence of organized crime.
Her involvement in this process has raised questions about justice, which should not be guided by political investment or the influence of organized crime, especially due to her institutional career and several questions that have been raised regarding the selection process and her suspected links to organized crime.
Sanxhaktar previously served at the Independent Qualification Commission, one of the most important institutions of justice reform. The KPK was responsible for the re-evaluation process of judges and prosecutors, a process that has radically changed the structure of the Albanian judicial system.
The decisions of this institution have had a direct impact on the careers of many magistrates and for this reason its activity has been followed with great attention by the public and the media. In many cases, the claim has been raised that this process has functioned more as a political vetting than as a genuine legal process, as the Sanxhatari himself is suspected of not having fulfilled the criteria to be at the head of this institution.
Pas kësaj periudhe, Sanxhaktari ka mbajtur edhe një pozicion drejtues në administratën qendrore, duke ushtruar detyrë pranë Kryeministria e Shqipërisë. Ky tranzicion nga një institucion i reformës në drejtësi drejt një funksioni të rëndësishëm në administratën ekzekutive ka ngjallur diskutime në disa qarqe të ekspertëve të drejtësisë, të cilët theksojnë rëndësinë e ruajtjes së distancës institucionale midis strukturave të drejtësisë dhe administratës politike.
Ndërkohë, procesi i përzgjedhjes për Gjykatën e Lartë në vetvete është një nga proceset më delikate në sistemin institucional të vendit. Ky institucion është autoriteti më i lartë gjyqësor dhe ka rol vendimtar në interpretimin e ligjit dhe në garantimin e unifikimit të praktikës gjyqësore. Për këtë arsye, çdo kandidat për këtë institucion duhet të kalojë në një proces të thelluar verifikimi profesional, etik dhe financiar.
Proceset e emërimeve në nivelet më të larta të sistemit gjyqësor duhet të shoqërohen me një transparencë maksimale dhe me verifikime të detajuara nga institucionet përkatëse, në mënyrë që të shmanget çdo dyshim mbi integritetin dhe pavarësinë e kandidatëve dhe jo të përzgjidhen në mënyrë të fshehtë persona të lidhur me grupe kriminale në krye të Gjykatës së Lartë.
Për më tepër, ekspertët theksojnë se përzgjedhja e anëtarëve të Gjykatës së Lartë nuk duhet të perceptohet si një proces i mbyllur institucional, por si një procedurë që kërkon llogaridhënie dhe transparencë publike, si dhe një hetim të thellë mbi tre kriteret kryesore: pastërtinë e figurës, pasurinë dhe aftësinë profesionale.
Në lidhje me pastërtinë e figurës janë ngritur dyshime për lidhje të mundshme me grupe kriminale, ndërsa njëkohësisht është përmendur se ajo ka qenë subjekt hetimi nga ana e Prokurorisë së Tiranës për veprën penale të vjedhjes duke shpërdoruar detyrën, fakt që sipas pretendimeve nuk është deklaruar.
Gjithashtu janë ngritur dyshime edhe në lidhje me pasurinë, pasi thuhet se Sanxhaktari zotëron pasuri të konsiderueshme financiare, për të cilat dyshohet se mund të kenë burime të pajustifikuara ose të lidhura me korrupsionin.
Nga ana tjetër, edhe në aspektin profesional janë ngritur pikëpyetje, pasi sipas pretendimeve Valbona Sanxhaktari nuk ka rezultuar e suksesshme në Shkollën e Magjistraturës dhe megjithatë sot është kandidate për një nga pozicionet më të larta në sistemin gjyqësor shqiptar.
Në një sistem demokratik, besimi i qytetarëve tek drejtësia ndërtohet jo vetëm përmes vendimeve gjyqësore, por edhe përmes mënyrës se si përzgjidhen dhe emërohen gjyqtarët që do të marrin këto vendime.
In this context, any question that arises in public opinion regarding the selection process of candidates for the Supreme Court must be treated seriously by the responsible institutions. Full verification of the candidates' profile, professional integrity and financial transparency remains an essential element to guarantee that this institution functions with the highest standards of independence and integrity.
Ultimately, the appointment process to the Supreme Court is more than an administrative procedure. It is a test of the functioning of justice reform and the ability of Albanian institutions to guarantee an independent, professional and trustworthy judicial system in the eyes of citizens./ Infront.org
