Spartak Ngjela: Why the Constitutional Court suspended the elections in Tirana

The Constitutional Court has suspended the decree for the early elections in Tirana, which were scheduled for November 9.

Regarding this, lawyer Spartak Ngjela stated that the Constitutional Court has suspended the elections after reviewing Erion Veliaj's appeal.

The lawyer explained that if the elections were held and the CC issued a decision after the 9th, they would not be valid.

" The Constitutional Court has suspended it because it will review Veliaj's appeal. Its decision is then law. The elections have not been canceled, but have been suspended until a decision is made. If elections are held and the decision was given after the elections, then the elections should have been canceled. There was no way the elections could be held as long as the Constitutional Court had not spoken. No one can appear before the Constitutional Court. There can be no elections until the Constitutional Court has suspended them and let's see now what decision it will make ," he said.

While focusing on the murder of Judge Astrit Kalaja in the courtroom of the Court of Appeal in Tirana, he described it as a serious event. Ngjela said that courts should have their own professional police to protect them.

" The court should have its own police. So far it doesn't have one, it needs a professional police force, and it's good that the government is considering this issue because it's important. It's serious to kill a judge ," he said.

The lawyer also focused on accusations of politics towards judges and prosecutors.

" Sali is to blame and criminal proceedings should have been initiated against him, because he spoke about judges and prosecutors in the worst possible way. A defendant can say whatever he wants because the law protects him, but what he says is low-level political. A law should be passed so that if these people speak like this against justice, they should go and do a psychiatric analysis, if they come out normal, then criminal proceedings should be initiated ," he said.
