The new Penal Code seems to be shaking up politics to its foundations. " Pamphlet " has secured the draft presented today by the Ministry of Justice and a large number of new articles have been introduced that deal with officials, where in some cases there are lightening of sentences and in some cases their harshening.

But in the new code, an article has been introduced for the first time, which, if implemented, will shake up politics. It concerns illicit enrichment.

It was Chief Prosecutor Olsian Çela who, for several years, has proposed the introduction of such an article, with the aim of punishing anyone who does not justify their wealth, even if it is not proven that they have committed a criminal offense.

According to the new provisions, any official who fails to justify his or her wealth can be sentenced to 2 to 7 years in prison. " Illegal enrichment, through a significant, important and unjustified increase in wealth, which exceeds the possibility of securing it with the legal income declared by the public official, is punishable by imprisonment for 2 to 7 years ," reads Article 314.

For more than 3 years, Chief Prosecutor Çela has proposed the introduction of such an article, which seems to hit ministers, MPs, and mayors who have sheikhs' wealth, but for whom there is no evidence of corruption affairs. 

" Initiating amendments and supplements to the Criminal Code, regarding: i) Adding an article "Illegal enrichment as a criminal offense in accordance with Article 20 of the UN Convention against Corruption, ratified by Law No. 9492/2006, with the aim of reducing corruption of public officials and combating informality ", stated Olsian Çela's proposal.

This proposal was repeatedly ignored, but the Ministry of Justice seems to have accepted this proposal and we hope that it will not change when the Code goes to Parliament, as MPs generally remove those articles that directly violate them. /Pamphlet
