The Prosecutor's Office of Tirana has reacted to the news published the day before that this prosecuting body has appealed for the return to prison of the former KLA fighter, Dritan Goxhaj.
Through an announcement, the prosecutor's office says that "as a prosecutor who conducts investigations and represents procedural requests in the first instance, she does not have the authority to appeal the decisions given by the Court of Appeal".
According to the Prosecutor's Office of Tirana, until January 16, the Court of Appeal has not yet clarified the decision and it has not been filed in the secretariat.
"The Prosecutor's Office at the Court of First Instance of General Jurisdiction Tirana, based on the information made public in the media about an appeal against the decision to release the citizen DG, informs how the prosecutor who conducts investigations and represents the procedural requirements at the level of first, it does not have within its powers the recourse of the decisions given by the Court of Appeal.
From the administered information, it appears that until yesterday, 16.01.2024, the Court of Appeal has not yet clarified the decision and it has not been filed in the secretariat.
For this reason, the procedural deadlines have not started for the General Jurisdiction Appeals Prosecution to exercise its right to recourse", says the reaction of the Tirana Prosecutor's Office.
