Debate on the Criminal Code/Consultative Roundtable in Durrës, Judges:

The consultative roundtable, organized by the Ministry of Justice, held in Durrës, focused on the uncertainties and problems that this draft brings to judicial practice.

One of the most sensitive issues raised by the judges was the draft's provision for criminal liability for decisions made by judges.

" How can it be presumed that a decision of mine that is not supported by a higher court is criminally liable?! There must be clear, precise, uninterpretable norms..." - says Judge Olti Skrame.

" Long and overloaded sentences, both conceptually and conceptually. There is confusion between material and procedural concepts and this can lead to problems in practice, " says Judge Suela Xhani.

The discussion also included the field of cybercrime, where according to the magistrates, the draft sets out provisions that are difficult to implement.

"The provisions I have seen, especially in the field of cybercrime, will be difficult to implement with the capacities we have, " said Judge Ervin Sulaj.

Another point of debate was bigamy, which in the new code remains a criminal offense, in defense of human dignity and women's rights.

The meeting in Durrës was the second of this cycle of consultations, while other roundtables are expected to take place in other cities in the country.

But this activity also had a direct consequence for citizens. Nearly 55 criminal and civil court hearings, scheduled today at the Durrës Court, were not held due to the participation of judges and prosecutors in this consultative meeting./ TCH
